Terms of Service for The Podcast App

1. ACCEPTANCE OF TERMS

By downloading, installing, or using The Podcast App ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App.

2. LICENSE TO USE

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not:

• Reverse engineer, decompile, or disassemble the App
• Redistribute, resell, or sublicense the App
• Remove or modify any proprietary notices
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems

3. USER ACCOUNTS

To use cloud sync features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these terms.

4. CONTENT AND INTELLECTUAL PROPERTY

The App allows you to access third-party podcast content via RSS feeds. You acknowledge that:

• You are responsible for ensuring you have rights to any content you import
• Podcast content is owned by the respective podcast creators
• We do not host, create, or control podcast content
• We are not responsible for the accuracy, legality, or quality of podcast content

The App itself, including design, code, and features, is owned by Magnolia Apps and protected by copyright and intellectual property laws.

5. SUBSCRIPTIONS AND PAYMENTS

Premium Subscriptions:

• Subscriptions are billed monthly or annually through your app store account
• Payment is charged to your app store account at confirmation of purchase
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
• Manage or cancel subscriptions in your app store account settings
• No refunds for partial periods
• Pricing may change with 30 days notice

Free Trial (if offered):

• New users only, one per account
• Cancel before trial ends to avoid charges
• Trial converts to paid subscription unless canceled

6. DATA USAGE AND PRIVACY

Your use of the App is subject to our Privacy Policy. By using the App, you consent to our collection and use of data as described in the Privacy Policy.

Network Usage:

• Streaming and downloads require internet connection
• Data charges may apply from your mobile carrier
• We are not responsible for data charges incurred

7. NOTIFICATIONS AND COMMUNICATIONS

By creating an account, you agree to receive:

• Transactional emails (account, sync status, subscription confirmations)
• Push notifications (new episodes, if enabled in settings)
• Service announcements (feature updates, policy changes)

You can opt out of non-essential communications in app settings.

8. APP AVAILABILITY AND CHANGES

We reserve the right to:

• Modify, suspend, or discontinue any feature at any time
• Change pricing for new subscriptions with notice
• Update these Terms with notice (material changes announced in-app)
• Perform maintenance that may temporarily limit access

We strive for 99% uptime but do not guarantee uninterrupted service.

9. DISCLAIMERS AND LIMITATIONS

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE ARE NOT LIABLE FOR:

• Loss of data or content
• Interruptions in service
• Third-party content accuracy or availability
• Compatibility with specific devices or OS versions
• Data charges from your carrier
• Damages arising from use or inability to use the App

MAXIMUM LIABILITY: Our total liability shall not exceed the amount you paid for the App in the past 12 months.

10. INDEMNIFICATION

You agree to indemnify and hold Magnolia Apps harmless from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of the App
• Your violation of any third-party rights

11. TERMINATION

We may terminate or suspend your account immediately for:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity

You may terminate your account at any time via Settings > Delete Account.

12. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, or in the state or federal courts located in your jurisdiction.

For EU users: You have the right to use the European Commission's Online Dispute Resolution platform for cross-border disputes.

13. SEVERABILITY

If any provision of these Terms is found invalid, the remaining provisions remain in effect.
