Terms of service

1. Acceptance

By downloading, installing or using The Podcast App, you agree to these terms. If you do not agree, do not use the app. The app is run by Magnolia Apps.

2. Accounts

• You can use the app without an account. If you sign in, you are responsible for activity on your account.
• We may suspend or end access for abuse, fraud, breaking these terms, or to comply with the law.

3. License and acceptable use

We give you a limited, revocable, non-exclusive, non-transferable license to use the app for personal, non-commercial use. You must not:

• Reverse engineer, decompile or disassemble the app.
• Resell, redistribute or sublicense the app or access to its services.
• Try to get unauthorized access, get around daily limits, or interfere with the service.
• Use the app for anything unlawful.

4. Podcast content

• The app plays podcasts from public RSS feeds. The shows belong to their publishers and rights holders.
• We do not guarantee that any show or episode is available, accurate, lawful or of any quality.

5. AI features

The app makes transcripts, chapters, summaries, ad-break markers, chat answers and other AI results.

• AI results can be wrong, incomplete or unavailable. They are for convenience, not professional advice.
• Free use of AI features has daily limits. Limits, models and providers can change.
• Transcripts belong to the episode and may be shared with every listener of that episode. They do not identify you.

6. YouTube features

The app uses YouTube API Services to find and play video versions of episodes. By using those features you agree to the YouTube Terms of Service. Google's handling of data is covered by the Google Privacy Policy.

7. Premium and billing

• Premium is a subscription sold through the Apple App Store or Google Play, under their terms. The price shown in the store is final.
• It renews until you cancel it in your App Store or Google Play subscription settings. Deleting the app or your account does not cancel it.
• Refunds, billing disputes and any trial are handled by the store under its rules.
• What is free and what is Premium can change. The current split is on the pricing section of the home page.

8. Changes to the service

• We may change, suspend or stop features at any time.
• We may apply limits and anti-abuse controls to keep the service reliable.
• We do not guarantee the service is always available.

9. Privacy

Your use of the app is also covered by our privacy policy.

10. Disclaimers and liability

The app is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows.

To the fullest extent the law allows, we are not liable for indirect, incidental, consequential, special or punitive damages, or for loss of data, revenue or goodwill, arising from your use of the app.

11. Ending use

You can stop using the app at any time and delete your account. We may suspend or end access for breaking these terms or to protect the service or its users.

12. Governing law

These terms are governed by the laws of the United States, without affecting consumer protections that apply where you live.

13. Changes to these terms

When these terms change, we update the effective date at the top and say what changed. Material changes may also be announced in the app.
